These general terms and conditions of sale (GTC) govern the relationship between the micro-enterprise ⟡Macram'Elo Créations⟡, represented by Elodie Bureaux, registered with the Trade and Companies Register and the Chamber of Crafts and Artisanship of Reims under SIRET number 977 840 792 00021, with its registered office at 55 rue Pierre Curie, 51230 Fère-Champenoise, and any individual or legal entity wishing to make a purchase on the e-commerce site www.macramelo-creations.com, hereinafter referred to as "the buyer".

These general terms and conditions of sale (GTC) define the rights and obligations between the company ⟡Macram'Elo Créations⟡ and the buyer and the conditions applicable to any purchase made through the website www.macramelo-creations.com.
The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having read prior to their order.
Before any transaction, the buyer declares, firstly, that the purchase of products on the site www.macramelo-creations.com is unrelated to their professional activity and is limited to strictly personal use, and secondly, that they have full legal capacity to enter into these general terms and conditions of sale.
The company ⟡Macram'Elo Créations⟡ reserves the right to modify these general terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its site. As a result, the applicable conditions will be those in force on the date of the buyer's order.

The products offered are those listed on the website www.macramelo-creations.com, namely, costume jewelry and artisanal accessories handcrafted with materials such as waxed polyester, stainless steel, brass, natural stones, and various beads, as well as recycled items from upcycling.
Unique pieces are in stock, while some models are made to order to avoid excess inventory.
The company ⟡Macram'Elo Créations⟡ reserves the right to modify the assortment of products at any time for diversification. Each product is presented on the website with a description and photos, detailing its main characteristics (e.g., colors, compositions, dimensions, use, etc.).
The photographs are as accurate as possible but do not bind ⟡Macram'Elo Créations⟡, as each creation is handmade, so slight variations may appear compared to the photographs presented on the site. The product photographs are therefore not contractual, except for unique pieces (as they are not reproduced).

✦ IV. Order-Price-Payment ✦
IV-I. Order
Orders are prepared within 24 to 72 hours, only if the ordered items are in stock.
Some items are made to order, so a maximum delay of 1 to 4 weeks applies before the order is shipped. The buyer will be informed if this is the case. The designer will make the jewelry or other items as soon as possible after the order validation.
Any order implies acceptance of the prices and the description of the products available for sale. Any dispute on this point will be handled within the framework of a possible exchange and the guarantees mentioned below.
In certain cases, notably default of payment, incorrect address, or other problems with the buyer's account, ⟡Macram'Elo Créations⟡ reserves the right to block the buyer's order until the problem is resolved.
In case of unavailability of the ordered product, the buyer will be informed as soon as possible and will have the option to cancel their order. The buyer will then have the choice of either requesting a refund of the sums paid within 14 days at the latest of their payment, or an exchange of the product.

IV-II. Price
The company ⟡Macram'Elo Créations⟡ reserves the right to change its prices at any time, but commits to applying the current rates indicated at the time of the order, subject to availability on that date.
The prices listed on the product sheets are indicated in euros (€) and are not subject to VAT, according to article: art. 293 B of the CGI.
Prices do not include delivery costs, which are charged extra and indicated before the order is validated. Shipping costs vary according to the weight of the items.
In the case of an order to a country other than metropolitan France, the buyer is the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of the company ⟡Macram'Elo Créations⟡. These customs duties will be borne by the buyer and are their sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in their country.
We advise you to inquire about these aspects with your local authorities and/or, where applicable, with the delivery company.

This is an order with payment obligation, meaning that placing the order implies payment by the buyer on the day of the order.

V-I. Delivery
Products are delivered to the delivery address indicated during the ordering process, within the timeframe specified on the order confirmation page. The buyer is therefore responsible for checking at the time of order that the delivery address is correct to avoid any delay or delivery error.
In case of a shipping delay by the company ⟡Macram'Elo Créations⟡, an email will be sent to the buyer to inform them of any potential impact on the indicated delivery time.
The following delivery times are those indicated on the carrier's website:

In case of delivery by a carrier, ⟡Macram'Elo Créations⟡ cannot be held responsible for the loss or theft of a parcel or for delivery delays due solely to the unavailability of the buyer or the carrier La Poste.

All elements of the website www.macramelo-creations.com are and remain the intellectual and exclusive property of the company ⟡Macram'Elo Créations⟡. The buyer undertakes to respect this content and is not authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site, whether in the form of photos, logos, visuals or texts, whether for personal or professional use. ✦ VIII. Returns, exceptions, and refunds✦
VIII-I. Returns
In accordance with article L121-20-12 of the Consumer Code, you have 14 working days from the delivery of your order to request a return, for exchange or refund without penalty, with the exception of return shipping costs, which remain your responsibility.
To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, in its original packaging and with accessories (pouches, boxes, gifts, etc.). You will also need the receipt or proof of purchase.

For any return due to a "breakage" (open, lost, broken rings, untied knots etc.) the buyer must contact customer service, explain the situation and send us photos via the form provided for this purpose:
VIII-II. Damage and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.
VIII-III. Exceptions / non-returnable items
According to article L 221-28 of the Consumer Code, certain types of items cannot be returned, such as custom products (e.g. special orders or personalized items).
Items on sale, promotion, or purchased with a promotional code will be refunded at the same price as stated on your invoice. Please do not hesitate to contact us with any questions or concerns regarding a specific item.
VIII-IV. Exchanges
The fastest way to ensure you get what you want is to return the item you have, after completing the return form and having it approved by us. Once the return is accepted, make a separate purchase for the new item.
VIII-V 14-day cooling-off period in the European Union
Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without justification. As above, your item must be in the same condition that you received it, unworn or unused, with original packaging and accessories (pouches, boxes, gifts etc.). VIII-IV. Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund.

✦ IX. Legal warranties ✦
IX-I. Legal warranty of conformity
The company ⟡Macram'Elo Créations⟡ guarantees the conformity of the goods sold to the contract, allowing the buyer to make a request under the legal warranty of conformity provided for in articles L. 217-4 et seq. of the Consumer Code.
In the event of implementation of the legal warranty of conformity, it is recalled that the buyer benefits from a period of 2 years from the delivery of the goods to act.
The buyer can choose between repair or replacement of the goods, subject to the cost conditions provided for in article L. 217-17 of the Consumer Code.
The buyer does not have to provide proof of the non-conformity of the goods during the 24 months for new goods (6 months for used goods) following the delivery of the goods.
This warranty does not cover defects caused by abnormal or improper use or resulting from modification or transformation of the product.
IX-II. Legal warranty against hidden defects
In accordance with articles 1641 et seq. of the Civil Code, the company ⟡Macram'Elo Créations⟡ guarantees against hidden defects that may affect the goods sold.
It will be up to the buyer to prove that the defects existed at the time of sale of the goods and are such as to render the goods unfit for the purpose for which they are intended. This warranty must be implemented within two years from the discovery of the defect.
The buyer can choose between rescission of the sale or a reduction in price in accordance with article 1644 of the Civil Code.
IX-III. Exclusions from warranty
Before shipping, each item is inspected (and possibly photographed if possible).
The company ⟡Macram'Elo Créations⟡ will not provide warranty for items that have suffered abnormal physical damage (burns, scratches, breakage), damage caused by oxidation (humidity, sweat, cosmetic or household products, etc.) or any other damage resulting from abnormal use (modification, transformation) of said items.

In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one month, the buyer, within the meaning of article L.133-4 of the Consumer Code, has the possibility to free of charge, if a disagreement persists, refer the matter to the competent mediator registered on the list of mediators established by the Mediation Evaluation and Control Commission of Consumption pursuant to article L.615-1 of the Consumer Code, namely:

✦ XI. Liability ✦
The company ⟡Macram'Elo Créations⟡, in the distance selling process, is bound only by an obligation of means. This means that it undertakes to do its utmost to fulfill its orders. Its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems.
